COMPLAINTS HANDLING POLICY

1. Policy Statement and Purpose

UK Clothing Caravan Ltd. is committed to maintaining high standards of professionalism, integrity, transparency and accountability across all areas of its business operations.

Our activities encompass the provision of cash for clothes services to members of the public, the wholesale supply of clothing and related products to commercial customers, and professional fundraising activities undertaken on behalf of charitable organisations.

We recognise that individuals, customers, donors, charity partners and other organisations may occasionally have concerns or experience dissatisfaction in connection with our services, business dealings or activities. We therefore believe it is essential that everyone has access to a fair, transparent and accessible complaints procedure.

The purpose of this Policy is to explain how complaints can be raised, recorded, investigated and resolved. It establishes the standards and procedures that UK Clothing Caravan Ltd. will follow when dealing with concerns relating to any aspect of our business, including our cash for clothes services, wholesale operations, customer relationships and professional fundraising activities.

We are committed to ensuring that complaints are handled promptly, impartially, consistently and respectfully. Where shortcomings are identified, appropriate corrective action will be taken, and lessons learned will be used to improve our services, customer experience, business practices and fundraising standards.

Our approach is guided by applicable consumer protection legislation, relevant commercial and contractual obligations, UK data protection legislation, the Fundraising Regulator’s Code of Fundraising Practice and any other relevant legal or regulatory requirements.

Where a complaint relates to fundraising activities undertaken on behalf of a charity partner, we will consider whether the relevant organisation should be informed or involved, in accordance with our contractual responsibilities and applicable regulatory and data protection requirements.

3. How to Make a Complaint

UK Clothing Caravan Ltd. aims to make the process of raising a complaint as accessible and straightforward as possible.

Anyone wishing to raise a concern or make a complaint may contact us using the telephone, email or postal details provided in Section 12 of this Policy.

To help us understand and investigate the matter effectively, individuals are encouraged to provide as much relevant information as reasonably possible, including:

  • Their name and preferred contact details;
  • A clear explanation of the complaint and the concerns being raised;
  • The date, approximate time and location of the incident, where applicable;
  • Details of any relevant conversations, transactions, interactions or previous correspondence; and
  • Any supporting documents, photographs or other information that may assist our investigation.

We appreciate that not everyone will have access to all the information requested. A lack of supporting documentation or incomplete details will not automatically prevent a complaint from being considered.

Where further clarification is reasonably required, we may contact the complainant to request additional information.

In circumstances involving personal information, confidential records or the exercise of data protection rights, we may need to undertake appropriate identity verification before disclosing information or taking certain actions.

Complaints may be submitted verbally or in writing. We will not insist that an individual completes a particular form or follows an unnecessarily complicated process before their concerns can be considered.

4. Complaints Management and Investigation Process

Every complaint received by UK Clothing Caravan Ltd. will be handled with care, impartiality and appropriate management oversight.

Complaints will be documented within our internal complaints management system and allocated to an appropriate person for assessment and investigation. The level of investigation will reflect the nature, seriousness and complexity of the matter.

4.1 Receipt, Recording and Acknowledgement

All complaints will be recorded on our internal complaints management system to ensure that they can be monitored, reviewed and appropriately followed up.

We aim to acknowledge complaints within 24 hours of receiving them.

Where appropriate, our acknowledgement will confirm:

  • That the complaint has been successfully received;
  • That the matter has been recorded within our internal system;
  • The relevant complaint reference number, where applicable;
  • The proposed next steps and investigation process; and
  • The anticipated timeframe for providing a more detailed response, where further investigation is necessary.

Where a complaint involves the handling or processing of personal data, it will also be managed in accordance with the applicable statutory requirements and relevant data protection procedures.

4.2 Investigation and Assessment

All complaints will be assessed and investigated objectively, thoroughly and proportionately.

Where reasonably practicable, responsibility for investigating a complaint will be assigned to someone who was not directly involved in the circumstances giving rise to it. Where this is not possible, management will consider alternative arrangements to provide an appropriate degree of independence and impartiality.

Depending on the nature of the complaint, the investigation may involve:

  • Establishing the relevant events, circumstances and facts;
  • Examining internal records, correspondence, transaction details and other available evidence;
  • Reviewing relevant clothing collection, wholesale order, delivery or fundraising records;
  • Obtaining information from employees, fundraisers or other relevant individuals;
  • Giving anyone whose conduct is being questioned a reasonable opportunity to provide an explanation;
  • Reviewing relevant company policies, procedures and operational practices;
  • Consulting charity partners, external advisers or other relevant parties where appropriate; and
  • Determining whether remedial, disciplinary, corrective or preventative measures are necessary.

We will take reasonable steps to understand the complainant’s concerns, including any particular outcome or resolution they would like us to consider.

All individuals involved in an investigation will be treated fairly, professionally and respectfully. We will seek to reach conclusions based on the available evidence rather than assumptions or personal opinions.

4.3 Response and Resolution Timescales

We aim to acknowledge complaints and provide an initial response within 24 hours of receipt.

Where a complaint requires additional investigation, we will explain the position to the complainant and provide an indication of when a more comprehensive response is expected.

Our objective is to resolve matters as efficiently as possible without compromising the quality or fairness of the investigation.

If circumstances arise that prevent us from meeting an anticipated response date, we will provide an update explaining:

  • The reason for the delay;
  • The current status of the investigation; and
  • When the complainant can reasonably expect to receive a further update or response.

Complaints involving personal data will be handled in accordance with applicable statutory time limits. In particular, where a complaint constitutes a request or matter subject to a specific data protection response deadline, the relevant legal requirements will take precedence over our internal service targets.

4.4 Investigation Findings and Resolution

Once the investigation has been completed, we will communicate the outcome to the complainant in a clear and appropriate manner.

Our response will normally include:

  • A summary of the issues and concerns considered;
  • An explanation of the investigation undertaken;
  • Our findings and conclusions;
  • The reasons supporting our decision;
  • Details of any corrective or remedial measures taken or proposed; and
  • Information about any relevant further escalation or review options.

Where an investigation establishes that an error, failure or inappropriate practice has occurred, we will consider the most suitable action to address the issue.

Depending on the circumstances, this may involve:

  • Offering an appropriate apology;
  • Correcting inaccurate or incomplete information;
  • Taking appropriate action in relation to an employee, fundraiser or representative;
  • Arranging additional guidance, supervision or staff training;
  • Amending existing policies, procedures or working practices;
  • Working with the relevant charity partner to address the concern; and
  • Introducing additional controls or preventative measures to reduce the likelihood of recurrence.

We recognise that resolving an individual complaint is only part of the process. We will also consider whether the circumstances identify wider issues that require improvements to our business operations or fundraising practices.

5. Fundraising Complaints and External Regulatory Review

As an organisation undertaking professional fundraising activities on behalf of charitable organisations, UK Clothing Caravan Ltd. recognises the importance of maintaining public trust and ensuring that all fundraising is carried out responsibly and ethically.

We are committed to meeting the applicable standards and requirements of the Fundraising Regulator’s Code of Fundraising Practice.

Where a complaint concerns fundraising conducted on behalf of a charity partner, we will consider the circumstances and determine whether the relevant charity should be notified, consulted or involved in the resolution process.

We will work constructively with charity partners and relevant regulatory organisations, providing appropriate assistance and information where required and permitted.

If an individual remains dissatisfied after we have considered their fundraising complaint, or where the matter cannot be resolved satisfactorily through our internal process, they may have the option of referring the complaint to the Fundraising Regulator.

Fundraising Regulator

Website: https://www.fundraisingregulator.org.uk

The Fundraising Regulator provides an independent route for considering eligible complaints about fundraising practices where concerns have not been satisfactorily resolved by the organisation concerned.

Where the relevant fundraising activity falls within the jurisdiction of the Scottish Fundraising Adjudication Panel, we will also provide appropriate information about the applicable alternative complaint resolution process.

6. Complaints Relating to Data Protection and Privacy

Protecting personal information and respecting the privacy rights of individuals are important responsibilities of UK Clothing Caravan Ltd.

Any complaint concerning the collection, use, access, storage, retention, disclosure, security or other processing of personal information will be referred for consideration in accordance with our internal data protection procedures and applicable UK data protection legislation.

We will take appropriate steps to establish the circumstances surrounding the complaint and assess whether our practices meet the relevant legal and regulatory requirements.

Where a complaint identifies a suspected or actual personal data breach, the matter will also be referred through our internal incident management procedures. We will assess the circumstances and determine whether any notification or reporting obligations apply.

If an individual is dissatisfied with the way we have addressed a data protection concern, they may refer the matter to the Information Commissioner’s Office.

Information Commissioner’s Office (ICO)

Website: https://www.ico.org.uk

Individuals are not required to exhaust our internal complaints procedure before contacting the ICO or exercising any statutory rights available to them under data protection legislation.

7. Safeguarding and the Management of Serious Concerns

UK Clothing Caravan Ltd. recognises its responsibility to conduct its activities in a manner that protects the welfare, dignity and interests of individuals, particularly those who may be in vulnerable circumstances.

Any complaint or report raising concerns about safeguarding, potential exploitation, harassment, intimidation, coercion, inappropriate behaviour or the treatment of vulnerable individuals will be given immediate and appropriate consideration.

Such matters will be escalated without unnecessary delay to a suitable member of management and addressed in accordance with our safeguarding procedures and any relevant legal obligations.

Where the circumstances require it, we may also involve the relevant charity partner, safeguarding professionals or appropriate external authorities.

We recognise that safeguarding concerns may require a different response from ordinary service-related complaints. They will therefore be treated as matters requiring appropriate management oversight, prioritisation and, where necessary, urgent action.

8. Confidentiality, Impartiality and Fair Treatment

We are committed to protecting the confidentiality of everyone involved in the complaints process.

Information relating to a complaint will be handled sensitively and shared only where there is a legitimate and reasonable need to do so, including for the purposes of:

  • Investigating and resolving the complaint;
  • Working with a relevant charity partner, where appropriate;
  • Meeting legal, contractual or regulatory responsibilities;
  • Protecting the rights, safety and legitimate interests of individuals; and
  • Establishing, exercising or defending legal claims.

All personal information obtained or generated during the complaints process will be managed in accordance with our data protection policies and applicable legislation.

No individual will be treated unfairly, disadvantaged or subjected to retaliation simply because they have raised a genuine complaint, expressed a concern or exercised their legal rights.

Equally, we expect everyone participating in the complaints process to act respectfully and appropriately. We will take reasonable steps to ensure that complaints are considered professionally, consistently and without discrimination.

9. Complaint Records and Retention

UK Clothing Caravan Ltd. maintains appropriate records of complaints received and the actions taken in response.

Depending on the circumstances, these records may include:

  • The date and method by which the complaint was received;
  • Details of the complainant and the issues raised;
  • Relevant correspondence and supporting evidence;
  • Investigation notes and findings;
  • Details of any individuals or organisations consulted;
  • Decisions, resolutions and corrective measures; and
  • The date on which the complaint was concluded.

All complaint records will be stored securely and access will be restricted to individuals who require the information for legitimate business, management, legal or regulatory purposes.

Records will be retained in accordance with our internal retention procedures and applicable data protection requirements. We will not retain complaint information for longer than is reasonably necessary to meet the purposes for which it was collected or to satisfy relevant legal, regulatory and business obligations.

Where appropriate, complaint records may be retained for a period of up to six years following the closure of the matter. A longer retention period may be justified where records are required in connection with ongoing legal proceedings, regulatory investigations or other legitimate requirements.

When information is no longer required, it will be securely deleted, destroyed or anonymised, as appropriate.

10. Management Oversight and Continuous Improvement

UK Clothing Caravan Ltd. views complaints as an important source of feedback and an opportunity to strengthen our services, operational standards and fundraising practices.

We will periodically assess complaints received to identify patterns, recurring concerns and areas where improvements may be necessary.

Our monitoring activities may consider:

  • The overall volume and nature of complaints;
  • Complaints relating to cash for clothes services and clothing collections;
  • Complaints relating to wholesale customers, orders, products and deliveries;
  • Complaints relating to fundraising activities, employees and representatives;
  • Common themes, recurring problems and emerging trends;
  • Whether complaints are being acknowledged and addressed within our intended timescales;
  • Whether agreed corrective actions have been completed; and
  • Opportunities to strengthen employee training, internal controls and operational procedures.

Significant complaints, recurring issues and relevant findings will be brought to the attention of senior management for appropriate consideration.

Where improvements are identified, relevant information and lessons learned may be communicated to employees, fundraisers and charity partners, where appropriate.

We will use the information obtained through our complaints process to support better decision-making, reinforce accountability and continually improve the standards expected throughout our organisation.

11. Policy Review and Communication

This Policy will be reviewed at least once every twelve months and sooner where necessary to reflect changes in:

  • Applicable legislation and statutory obligations;
  • The Fundraising Regulator’s Code of Fundraising Practice;
  • Regulatory guidance and industry standards;
  • Our contractual responsibilities to charity partners; or
  • The nature and scope of our business activities.

Management is responsible for ensuring that this Policy remains appropriate, effective and accessible.

Employees, fundraisers and representatives who may receive or handle complaints must understand their responsibilities and follow the procedures set out in this document.

The Policy will be made available to relevant employees, representatives, charity partners and members of the public, as appropriate.

UK Clothing Caravan Ltd. remains committed to maintaining an effective, accessible and transparent complaints process that supports public confidence and encourages accountability throughout the organisation.
